The Circuit Clerk serves as clerk of the civil, domestic relations, criminal, and juvenile courts. This office is also the ex-officio county recorder for land documents. Court records held here include civil case filings, criminal case histories, divorce records, and domestic relations files. Juvenile court records are restricted. Land documents such as deeds, mortgages, liens, and plats are also filed and indexed here.
New civil or domestic case filings cost $165.00. Reopening a cause of action runs $50.00. Certified copies of documents are $5.00 each. Summons and subpoenas cost $2.50 per person. Recording fees for land documents are $15.00 for the first page and $5.00 for each additional page. The Real Property Transfer Tax is $3.30 per $1,000 of consideration on sales over $100. This office issues marriage licenses at a cost of approximately $60.00. Both parties must appear in person with a valid photo ID and social security cards. There is no waiting period for adults 18 and older, and a license is valid for 60 days from the date of issue. The Clerk also handles voter registration, which must be completed at least 30 days before any election.
Probate records held by the County Clerk include decedent estates, guardianships, and adoptions. Adoption records are sealed by state law. Probate case filing fees are about $165.00. The office also keeps DBA filings, county court orders, and quorum court minutes. Copies cost $1.00 per page. Add $5.00 for certification. Mail requests should include a self-addressed stamped envelope and a money order for payment.
